About These Terms

These Terms & Conditions apply to purchases and services supplied by Shipping Containers Pty Ltd, ABN 41 635 891 735.

By placing an order with us, you agree to the terms applicable to that order together with any quotation, invoice or written agreement provided to you.

If a written quotation or agreement contains terms that are specific to your order, those terms should be read together with these general Terms & Conditions.

Product Information

We aim to provide clear and accurate information about the containers offered on our website.

Container appearance, age, markings and condition may vary, particularly for used containers.

• Product photographs may be representative where multiple containers of a similar type are available.
• Used containers may have dents, scratches, repairs, surface corrosion, previous markings or other signs of normal prior use.
• Dimensions, weights and capacities shown on general information pages are approximate unless the individual product listing states otherwise.
• Customers should review the individual product description before ordering.

Pricing, GST & Quotations

Prices are displayed or quoted in Australian Dollars unless otherwise stated.

GST treatment will be shown on the relevant product page, quotation, checkout or tax invoice as applicable.

Delivery may be charged separately depending on the destination, container type and transport requirements.

A quotation is subject to the availability and terms stated on that quotation. If an expiry date applies, it will be shown on the quotation.

Orders & Availability

An order is subject to product availability and confirmation by Shipping Containers Pty Ltd.

Stock availability may change between an enquiry, quotation and final order confirmation.

If a product becomes unavailable after an order has been placed, we will contact you to discuss an appropriate alternative, updated timing or other available resolution.

Payment

Payment requirements will be stated during checkout, on your quotation or on your invoice.

Where payment is required before dispatch or collection, the container will not normally be released until the required payment has been received.

Customers should only make payment using payment instructions issued through our website, official quotation, invoice or authorised communication.

Shipping & Delivery

Delivery availability, charges and timing depend on the delivery location, container size, transport requirements and site access.

Customers are responsible for providing accurate delivery information and telling us about any known access limitations.

Delivery drivers may decline to enter or unload at a location where the site is considered unsafe or unsuitable for the delivery vehicle.

Where delivery cannot be completed because of inaccurate customer-provided access information or another customer-controlled issue, additional transport charges may apply. Any further charges will be communicated before re-delivery is arranged.

Customer Collection

Collection may be available for selected containers and locations by prior arrangement.

Customers must not attend a collection location until the collection details, availability and loading arrangements have been confirmed.

Customers arranging their own transport are responsible for using an appropriate vehicle and complying with applicable transport and load-restraint requirements.

Changes & Cancellations

If you need to change or cancel an order, contact us as soon as possible.

Whether an order can be changed or cancelled may depend on its status, whether transport has been arranged, whether work has commenced and whether the product has been specially sourced or modified.

Any cancellation or change fee will only apply where it has been disclosed or is otherwise permitted by law.

Nothing in this section limits any right you may have under Australian Consumer Law.

Custom & Modified Containers

Where custom modification work is requested, specifications should be agreed before work begins.

Modification costs, deposits, production timing and any restrictions on changes or cancellation should be stated in the applicable quotation or written project agreement.

Customers are responsible for ensuring that any intended use of a modified container complies with applicable planning, building, electrical, health, safety or other regulatory requirements.

Container Hire

Where a container is hired rather than purchased, additional hire terms may apply and will be provided as part of the relevant hire agreement or quotation.

Unless otherwise agreed in writing, hired containers remain the property of the owner and must not be materially altered without authorisation.

Customers should not use hired containers for unlawful purposes or store goods in a way that breaches applicable safety or environmental requirements.

Returns, Refunds & Problems With an Order

If you believe a container supplied to you is incorrect, damaged beyond the stated condition or otherwise has a problem, contact us as soon as reasonably practical.

Please provide your order information and photographs where appropriate so the issue can be assessed.

Returns, refunds, repairs, replacements or other remedies will be handled in accordance with our applicable policy and Australian Consumer Law.

Australian Consumer Law

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any guarantee, right or remedy that cannot lawfully be excluded under Australian Consumer Law.

Where Australian Consumer Law applies, customers may have rights and remedies in addition to anything expressly stated in these Terms & Conditions.

Delays & Events Outside Our Control

From time to time, fulfilment or delivery may be affected by circumstances outside our reasonable control.

Examples may include severe weather, road closures, transport interruptions, carrier delays, supply interruptions or other operational events.

Where possible, we will use reasonable efforts to communicate material changes affecting an existing order.

Liability

To the extent permitted by law, Shipping Containers Pty Ltd is not responsible for loss caused by misuse of a container, unauthorised alterations, unsuitable site conditions or circumstances outside our reasonable control.

This section does not limit liability where doing so would be prohibited by applicable law.

Privacy

Personal information collected through enquiries, orders and website use is handled in accordance with our Privacy Policy.

Applicable Law

These Terms & Conditions are governed by the laws applicable in New South Wales, Australia, together with applicable Commonwealth laws.

Nothing in these terms is intended to prevent a customer from exercising any legal right regarding jurisdiction or dispute resolution that cannot lawfully be excluded.
